1. Acceptance of Terms

By accessing or using the oAssessor platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Service. These Terms apply to all visitors, users, and organisations that access or use the Service.

2. Description of Service

oAssessor is a computer-based testing (CBT) platform that enables organisations ("Administrators") to create, manage, and deliver online assessments to candidates. Features include exam creation, candidate management, anti-cheat proctoring, automated scoring, and result reporting.

3. Accounts & Registration

Organisations must register an account to use the administrative features of the Service. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must immediately notify us at info@oassessment.ng of any unauthorised use of your account.

You must provide accurate and complete information when creating an account and keep it up to date. Accounts may not be shared or transferred to another party without our prior written consent.

4. Acceptable Use

You agree not to use the Service to:

• Upload or transmit unlawful, harmful, defamatory, or fraudulent content;
• Impersonate any person or entity or falsely state your affiliation;
• Interfere with or disrupt the integrity or performance of the Service;
• Attempt to gain unauthorised access to any part of the Service or its infrastructure;
• Use automated tools to scrape, crawl, or extract data from the Service without permission.

5. Content Ownership

You retain ownership of all exam content, questions, and candidate data you upload to the Service. By uploading content, you grant oAssessor a limited, non-exclusive licence to store and process that content solely for the purpose of providing the Service to you.

The oAssessor platform, including its design, software, and documentation, is owned by oAssessor and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the platform without express written permission.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Limitation of Liability

To the fullest extent permitted by law, oAssessor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on the Service or by sending an email. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State.
